Statement of the German data protection authority play? At its meeting on April 26, 2018 in Düsseldorf, the conference of independent data protection authorities of the federal government and the state data protection conference DSK determined its position on the applicability of the TMG for non-public bodies from May. With a view to the future ePrivacy Regulation, the DSK Position takes a position on the tension between the TMG GDPR and the ePrivacy Directive and makes General statements on the use of tracking mechanisms on the Internet and the creation of user profiles. The European Court of Justice is currently dealing with this issue and a decision is still pending. On the German market the acceptance of the data protection authorities and the pending ECJ decision is causing confusion as to the extent to which this now applies. Awin has decided that we will with applicable laws as the Data Protection Authorities acceptance could be declared an error by the ECJ. However we cannot say with complete certainty that publishers can rely on not having to obtain consent for tracking. This involves a risk which Awin is willing to take in order to significantly reduce the burden on our publishers.
